Think Then Play Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Think Then Play website and mobile application (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) What Think Then Play Is
Think Then Play provides cognitive training tools designed to support athletic performance, including reaction speed, focus, and decision-making. The Service is intended for training and educational purposes only.
2) Not Medical or Professional Advice
Think Then Play is not a medical, healthcare, or therapeutic service. Nothing on the Service is medical advice, diagnosis, or treatment. Always consult a qualified professional before starting any new training program, especially if you have an injury or health condition.
3) Eligibility
You must be able to form a binding contract to use the Service. If you are using the Service on behalf of a minor, you confirm you are the parent/legal guardian and you are responsible for supervising use and accepting these Terms on their behalf.
4) Your Responsibilities
You agree to use the Service responsibly and safely. You are responsible for:
- Choosing appropriate training intensity for your ability and environment
- Using the Service in a safe space (e.g., avoiding hazards while training)
- Stopping immediately if you experience pain, dizziness, or discomfort
5) License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.
You agree you will not:
- Copy, reproduce, distribute, sell, rent, or sublicense any part of the Service
- Reverse engineer, decompile, or attempt to extract source code
- Remove, obscure, or alter any proprietary notices
- Use the Service in a way that violates laws or infringes others’ rights
- Attempt to disrupt, overload, or interfere with the Service
6) Intellectual Property
The Service and all related content, features, and functionality (including design, text, graphics, videos, software, and branding) are owned by Think Then Play and its licensors, and are protected by intellectual property laws.
7) Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
8) Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9) Limitation of Liability
To the maximum extent permitted by law, Think Then Play and its creators will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service.
10) Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or are misusing the Service.
11) Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of laws principles. Any disputes will be resolved exclusively in the courts located in Ontario, Canada.
(If you’d rather align this with the U.S. because your customer base is mostly U.S., you can change this section to your preferred state.)
12) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Your continued use of the Service after changes means you accept the updated Terms.
